Trademarks Customs Watch Program

Our Customs Watch Service is activated by the request of the interested party; however, the Customs Authority can intervene autonomously.

To achieve maximum efficiency, the interested parties’ request must include a precise description of the IP rights to be protected (for example, description of the trademark and the way it is used); proof of ownership of the rights by the applicant; information related to the ways in which infringement could occur (which is essential for allowing the service to operate effectively).

TASKS’ Customs Watch Service functions as follows:

  1. Customs officers confiscate the suspected goods.
  2. The IP owner is informed and provided with a detailed description and samples of the seized goods.
  3. The owner is then given a certain period to decide (3 -14 days, varies from one country to another) whether to take this issue to court or not; upon which a copy of the legal action must be sent to the Customs.
  4. If decided to take the issue to court; a legal action will then be normally proceeded.
  5. If any of the above conditions are not observed the goods will be released.

It is to be noted that the Customs Authorities in some countries can initiate a court action ex officio.
